The main goal of REACH and RoHS regulations is to ensure short and long-term consumer and environmental safety in a circular economy framework.
EC Regulation No 1907/2006 “REACH” (Registration, Evaluation, Authorisation and restriction of CHemicals) applies to all the chemical substances in use or imported into Europe.
In particular, maximum levels of presence in consumer goods are set out for a series of chemical compounds in different product categories: fabrics, jewels, furniture, cosmetic products, toys, shoes, etc. The regulation does not replace but adds to any other specific regulation for some matrices: Regulation on cosmetic products (EC No 1223/2009), Toy Safety Directive No 2009/48/EC, RoHS Directive No 2011/65/EU, etc.
REACH Regulation sets out that the legal responsibility linked to the chemical substances lies with the companies manufacturing, importing and/or marketing the products. The compliance with the restrictions set out in Annex XVII and the possible presence of SVHC (Substances of Very High Concern) in the Candidate List must be verified. SVHC include molecules classified as CMR (carcinogenic, mutagenic or toxic to reproduction) substances, persistent substances, bioaccumulative and toxic substances and in general all the compounds that might cause detrimental effects on human health and/or the environment such as endocrine disruptors.
In addition, a SCIP notification requirement was introduces in 2021. It is therefore mandatory to submit a notification to ECHA (European Chemicals Agency) regarding all articles containing SVHC in a concentration above 0.1% w/w.
As regards electrical and electronic equipment (EEE), it is mandatory to comply with the requirements set out in RoHS Directive No 2011/65/EC 'Restriction of Hazardous Substances Directive' and EU Delegated Directive No 2015/863, restricting the use of chemicals such as lead (Pb), cadmium (Cd), mercury (Hg), hexavalent chromium, polybrominated biphenyls (PBB), polybrominated diphenyl ethers (PBDE) and phthalates.
The RoHS Declaration of Conformity of finished EEE products and all the materials and components that constitute them is mandatory not only for those who manufacture and market them, but also for those who resell equipment manufactured by others with their own brand.
